1 Introduction

MERKARY VIAJES S.A.C (here in after “MERKARY VIAJES”), identified with R.U.C. No. 20601801109, we are committed to maintaining the privacy and protection of information of our customer prospects, customers, visits, suppliers and collaborators in accordance with the provisions of Law No. 29733, Law on Protection of Personal Data, its Regulations and complementary standards, taking the necessary technical and organizational measures to avoid loss, misuse, alteration, unauthorised access and theft of personal data provided by their owners. Merkary Viajes also ensures the continuous improvement of these measures.

In this context, we declare the following guidelines that we must inform our prospects of customers, customers, visitors, suppliers and collaborators, clearly and unequivocally, when their personal data is collected through any of our channels:

The existence of the processing of personal data, the purpose of the collection and recipients of the information.

Obligatory or optional nature of the answer to the questions that may be asked, as well as the consequences of the collection of personal data or the refusal to provide them.

2. Identification and address of the holder of the data banks

Merkary Viajes S.A., identified with R.U.C. No. 20601801109y with address at AV. LARCO NRO. 345 INT. 802 LIMA – MIRAFLORES is a private company that provides tourist services.

3. Definitions

Personal Data: Any information about a natural person that identifies or makes it identifiable through means that can be reasonably used. For example, names, identity documents, telephone numbers, among others, that identify or may identify an individual.

Processing of personal data: Any technical operation or procedure, automated or not, that allows the collection, registration, organization, storage, storage, processing, modification, extraction, consultation, use, blocking, deletion, communication by transfer or dissemination or any other form of processing that facilitates the access, correlation or interconnection of personal data.

4. Purposes

The personal data of which the processing is carried out have the following purposes:

For the Data Bank called “Customer Prospectus”:

Record and store the personal data of potential customers, interested persons, and former customers for sending offers, promotions and/or advertising.

For the “Customers” Data Bank:

Have a record of information of all customers. This database is used to send commercial benefits, offers, promotions and/or advertising, as well as to define commercial strategies, define trends, consumption behaviors and develop tariff plans, define offers and promotions attractive to customers.

With respect to the “Suppliers” Data Bank:

Keep track of the information of our suppliers, we create information files of each. These files are updated periodically and are part of our evaluation when deciding the purchase of goods or services.

For the “Collaborators” Data Bank:
Have an updated database of company personnel.

Regarding the Data Bank called “Access Control”:

Collect the data of people entering public and non-public areas of Merkary Viajes to perform access control by security measures.

Regarding the Data Bank called “Video Surveillance – Internal Facilities”:

To have the recording of images for the control of security measures of the internal facilities of Merkary Viajes.

Regarding the Data Bank called “Video surveillance – Commercial Offices”:

To have the recording of images for the control of security measures of the commercial facilities of Merkary Viajes.

5. Mandatory personal data

To carry out the purposes described in this privacy policy, it is mandatory to provide us, at least, the following personal data: name and surname, number and type of identity document, fingerprint (where applicable) credit and/or debit card details (where applicable), picture (where applicable, address (where applicable), e-mail address (where applicable), and telephone number (where applicable).

6. Consequences of providing personal data and refusal to do so

Unfortunately, if you do not allow us to access, at least, the data described in the previous section, it will be impossible to generate a commercial relationship with you, so we will be unable to comply with the offers promoted through our different platforms.

7. Transfer of personal data to third parties

Merkary Viajes may transfer your personal data nationally and internationally, with the following types of companies, and for the purposes detailed below:

Business Partners

Purpose: Define commercial strategies, define trends, consumption behaviors, develop tariff plans, define offers and promotions attractive to customers.

Processors

Purpose: Support services such as: data processing, marketing of our products and/or services, hosting providers, collection procedures, among others.

It should be noted that these companies are not authorized to use the personal data we share with them for any purpose other than that indicated in the terms of this Privacy Policy. When Merkary Viajes proceeds in this way, it will take the precautions that according to the current law are necessary to protect the confidentiality and security of your personal data.

Financial and banking institutions

Purpose: Processing of payments for the provision of our services and/or marketing of our products.

Public Administration

Purpose: Compliance with current regulations.

Where appropriate, before disclosing personal data to a third party, Merkary Viajes will contractually require the third party to take the necessary precautions to protect the data from unauthorized use or disclosure.

8. Identification of Personal Data Banks

The personal data you provide us, will be stored in the following Data Banks:

Customer Prospect Personal Data Banks (RNPDP Code No. 6530),

Customer Personal Data Banks (RNPDP Registration Code No. 887)

Access Control Personal Data Banks (RNPDP Code No. 17682)

Video Surveillance Personal Data Banks – Internal Facilities (RNPDP Code No. 16824)

Video Surveillance Personal Data Banks – Commercial Offices (Code RNPDP No.17201)

Suppliers’ Personal Data Banks (RNPDP Code No. 886)

Personal Data Banks of Collaborators (RNPDP Code No. 885)

9. Retention time of personal data

Customer information will be stored for up to 10 (ten) years after completion of the purposes described in this Policy, as mandated in Board Resolution No. 138-2012- CD-OSIPTEL.

The personal data of the customer leaflets will be stored for two (2) years, if you have given your consent to process your data for additional purposes (advertising topics).

The images stored from the camcorders will be stored for a period of 30 days and up to a maximum period of 60 days, as indicated by Video Surveillance Directive, Directive N° 01-2020-JUS-DGTAIPD.

The personal data of the employees will be stored for five (5) years after the termination of the employment relationship, as provided for in article 3 of Legislative Decree No. 1310, Legislative Decree approving additional measures of administrative simplification; or until the statute of limitations expires for the worker to claim his labor benefits, AFP contributions or disciplinary sanctions imposed.

The suppliers’ personal data will be stored for the duration of the contractual relationship.

The personal data of the visits will be stored for two (2) years, for the control of accesses by security measures.

10. Security and confidentiality

Merkary Viajes has all the necessary technical, legal and organizational measures to guarantee the security and confidentiality of your personal data. Your personal data will be processed considering the principles of legality, consent, proportionality, quality, security and the others present in the current regulations concerning Personal Data Protection, preventing them from being filtered, or any action that endangers your personal information.

11. Exercise of their rights

Merkary Viajes, concerned that the best treatment of your personal data is provided, informs you that you have the right to exercise your rights of access, rectification, cancellation and opposition in any of our Merkary Viajes care centers, as well as entering the following link: Request for ARCO rights.

12. Changes to the Privacy Policy

Merkary Viajes reserves the right to modify and/or update this Privacy Policy as part of its continuous improvement, either to adapt it to future regulatory changes, provide a better quality of service or communicate new alternatives related to this Policy.

You will be notified of any changes to this Privacy Policy by posting the updated or modified version of this Site. When you use this Site, the Merkary Travel App or other means where you become aware of this Privacy Policy after such changes, you agree that any personal data obtained from you or about you after the revision of the Privacy Policy is subject to the revised Privacy Policy.
